TERMS AND CONDITIONS

Sale of Physical Goods & Digital Products

1. ABOUT US

Grace My Events is a partnership trading in England and Wales.

References to “we”, “us” and “our” mean Grace My Events.
References to “you” mean the customer.

These Terms apply to all purchases made via our website, social media platforms, email or other distance selling methods.


2. LEGAL FRAMEWORK

These Terms are governed by:

  • Consumer Rights Act 2015

  • Consumer Contracts Regulations 2013

  • Data Protection Act 2018 and UK GDPR

Nothing in these Terms affects your statutory rights.


3. DEFINITIONS

Goods – Physical products including gifts, personalised items, stationery, décor and retail items.

Digital Products – Downloadable files including templates, guides, printables, artwork or electronic content.

Contract – The agreement between you and Grace My Events.


4. FORMATION OF CONTRACT

4.1 An order constitutes an offer to purchase.

4.2 A contract is formed only when:

  • Full payment has been received; and

  • We issue written confirmation of acceptance (including email confirmation).

4.3 We reserve the right to refuse or cancel an order due to:

  • Pricing errors

  • Stock unavailability

  • Suspected fraudulent activity

If cancelled, a full refund will be issued without undue delay.


5. PRICES & PAYMENT

5.1 All prices are in GBP (£).

5.2 VAT is included where applicable.

5.3 Delivery charges are clearly displayed before checkout.

5.4 Full payment is required before dispatch of goods or release of digital products.


6. DELIVERY OF PHYSICAL GOODS

6.1 Goods will be delivered without undue delay and within 30 days unless otherwise agreed.

6.2 Delivery times are estimates only and not guaranteed.

6.3 Risk passes to you when the goods come into your physical possession.

6.4 We are not responsible for delays caused by postal or courier services outside our control.


7. YOUR RIGHT TO CANCEL (NON-PERSONALISED GOODS)

Under the Consumer Contracts Regulations 2013:

7.1 You have 14 days from the day you receive goods to cancel your order (change of mind).

7.2 You must notify us in writing within the 14-day period.

7.3 You then have a further 14 days to return the goods.

7.4 Return postage costs for change-of-mind returns are the responsibility of the customer.

7.5 Goods must be returned unused and in their original condition.

7.6 Refunds will be issued within 14 days of receiving the returned goods.

We may reduce the refund if the value of the goods has been diminished through handling beyond what is necessary to inspect them.


8. ITEMS EXEMPT FROM CANCELLATION

The right to cancel does not apply to:

  • Personalised or custom-made items

  • Goods made to your specification

  • Sealed goods which are not suitable for return for hygiene reasons once opened including hair accessories

These items are non-refundable unless faulty.


9. FAULTY OR DAMAGED GOODS

Under the Consumer Rights Act 2015, goods must be:

  • Of satisfactory quality

  • Fit for purpose

  • As described

If goods are faulty:

Within 30 Days of Receipt

You are entitled to reject the goods and receive a full refund providing we are notified within 24 hours of receipt

Return postage costs for faulty goods will not be be reimbursed.

We may request photographic evidence before considering a refund or replacement.


10. DIGITAL PRODUCTS

10.1 Digital products are supplied electronically.

10.2 By purchasing a digital product, you expressly consent to immediate access and acknowledge that you lose your 14-day cancellation right once download begins, in accordance with the Consumer Contracts Regulations 2013.

10.3 Digital products:

  • May be downloaded once only

  • Must be downloaded within 90 days of purchase

  • Will be permanently deleted after 90 days

  • Will not be reissued after deletion

It is your responsibility to download and securely store your files.


10.4 Digital Product Refunds

Due to the nature of digital products:

  • All digital product sales are final

  • No refunds are provided once access has been granted

  • Refunds will only be considered if the file is demonstrably faulty or corrupted


10.5 Licence & Intellectual Property

All digital products, designs, artwork, templates and branding remain the intellectual property of Grace My Events.

Purchase grants you a personal, non-transferable licence for private 1 use only.

You must not:

  • Copy or reproduce

  • Share or distribute

  • Resell

  • Upload to third-party platforms

  • Claim as your own work

  • Use for commercial resale

Strictly no reproduction or resale is permitted.

We reserve the right to take legal action for copyright infringement.


11. PRODUCT DESCRIPTIONS

We take reasonable care to ensure that product descriptions, images and specifications are accurate.

Colours may vary due to screen settings.

Measurements are approximate unless stated otherwise.


12. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Your statutory consumer rights

Subject to the above, our total liability shall not exceed the purchase price paid.


13. DATA PROTECTION

We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

Personal data is used solely for:

  • Processing orders

  • Customer communication

  • Legal and accounting obligations

We do not sell personal data to third parties.


14. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
